Welcome to the Informational Website for the Falco v. Nissan Settlement.
A class action settlement, known as Falco, et al. v. Nissan North America, Inc., et al., Case No. 2:13-cv-00686-DDP- MANx gained preliminary approval by the court on February 1, 2018. The Settlement resolves a lawsuit about Nissan’s obligations, if any, related to the timing chain systems in the following models:
|2004-2006 Nissan Altima (VQ35 engine)||2005-2007 Nissan Frontier (VQ40 engine)|
|2004-2008 Nissan Maxima||2005-2007 Nissan Pathfinder|
|2004-2009 Nissan Quest||2005-2007 Nissan Xterra|
You may be able to get a partial refund if you paid to repair the engine timing chains in your Nissan vehicle, or if you need to have them repaired in the future.
If your vehicle is making a high frequency buzzing or whining noise coming from the engine that increases in frequency with engine speed, this may indicate your timing chain system needs to be repaired.
If you have not yet had your vehicle repaired, to be eligible for reimbursement under the Settlement, you must first have your vehicle diagnosed by an authorized Nissan dealership. If the authorized Nissan dealership determines that repair or replacement of your primary or secondary timing chain system is necessary because of a broken slack guide retention clip, an unseated slack guide, or worn secondary tensioner shoes, you may be eligible for reimbursement of a portion of the diagnosis and repair costs from Nissan.
